Another Victory for Students In Our Historic Davids v. New York Lawsuit

Appellate Division of the New York State Supreme Court Puts Students’ Interest First

The plaintiffs of Davids v. New York are pleased the Appellate Division of the New York State Supreme Court has ruled in favor of the children of New York.

Davids v. New York was filed on July 3, 2014 by the students and parents of the New York City Parents Union.

The courts have deemed that our “complaints are legally sufficient” in that the New York State Legislature, the New York City Department of Education, the NYS Board of Regents, New York State United Teachers and the United Federation of Teachers are failing to provide New York public school students with a sound and basic education.

We whole heartedly look forward to the discovery process where we will finally be able to pull back the curtain and expose how tedious dismissal procedures and Last In First Out rules lead to ineffective teachers in the classrooms, with a concentration of ineffective teachers in our poorest and most needy communities.

The public schools system is broken, and we can no longer allow the United Federation of Teachers, New York State United Teachers and our state legislators they fund to write education laws and policies simply for the benefit of adults without proper consideration for the children they are supposed to serve.

Historic Davids v. New York Lawsuit Is Going To Trial

Judge Minardo Denied The Teachers Union’s Motion To Dismiss

Today, Judge Minardo denied the United Federation of Teachers, New York State United Teachers, New York City Department of Education and New York State Attorney General’s Motions to Dismiss the historic, parent-organized Davids v. New York Lawsuit.

Davids v. New York seeks to declare as unconstitutional certain provisions within New York State’s Education Law that deny students the “sound basic education,” considered a fundamental right under Article XI, §1 of the New York State Constitution. 

Davids v. New York  is about modernizing the teaching profession and ensuring that our education system is performance-based and not quality-blind.  Above all, this lawsuit is an affirmation of the importance of teachers to the quality of students’ education and it is a challenge for all of us to do things differently to make sure our students are getting all of the resources they need to succeed.  New books and desks are not enough; there must be a highly motivated, highly effective teacher in each classroom every day.

Jonathan Tribiano, Esq., General Counsel for Davids v. New York plaintiffs said:   “We believe Justice Minardo’s decision today is sound. We also believe the issues in this case are ripe for determination.”

Mona Davids, Lead Plaintiff and President of the New York City Parents Union said:  “We are happy that our voices will finally be heard.  The teachers union’s argument that parents have no standing and no right to demand accountability, expect our children to be educated and in a safe environment, was outrageous.  We are the real stakeholders because it is our children in the New York State public school system and this trial allows us to bring our own chairs to the education policy table.”
